1. Agreement
These Terms form a binding agreement between you and COLMUS INC. ("Colmus", "we", "us"), operator of the Obsidian Command platform (the "Platform"). By accessing the Platform you accept these Terms and the Acceptable Use Policy.
2. License
Subject to compliance, Colmus grants you a limited, non-exclusive, non-transferable, revocable license to access the Platform for lawful internal business or research use. All Platform IP, models, pipelines, and visual systems remain Colmus property.
3. Accounts & security
You are responsible for credentials, activity under your account, and immediate notification of suspected compromise. We may suspend access to protect the Platform or its users.
4. AI outputs
All briefings, dossiers, alerts, scores, and synthesized analyses are AI-generated from public-source intelligence and may be incomplete, outdated, or incorrect. Outputs are informational only and are not legal, financial, investment, medical, security, or operational advice. You must independently verify before acting.
5. Prohibited use
You will not use the Platform for unlawful surveillance, harassment, doxxing, intrusion, interception, scraping that violates third-party terms, sanctions violations, attacks on civilian infrastructure, or any activity prohibited by the Acceptable Use Policy.
6. Fees
Paid plans renew automatically until cancelled. Fees are non-refundable except where required by law. Enterprise agreements supersede standard terms where applicable.
7. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COLMUS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. AGGREGATE LIABILITY WILL NOT EXCEED AMOUNTS PAID TO COLMUS IN THE TWELVE MONTHS PRECEDING THE CLAIM.
9. Indemnity
You will defend and indemnify Colmus against claims arising from your use of the Platform in violation of these Terms or applicable law.
10. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Disputes will be resolved by binding arbitration administered by JAMS in Wilmington, Delaware, except where prohibited.
11. Changes
We may update these Terms. Material changes will be announced via the Platform or email. Continued use after the effective date constitutes acceptance.
